The service Fraudient is offered online as a Software-as-a-Service (SaaS) by Fraudient.com. The following terms and conditions govern the use of Fraudient. By using Fraudient, you agree to these terms and conditions.
Any deviations from these terms require the prior written confirmation of Fraudient.com.

1. Use of the Service
1.1 The Service is compatible only with the ad platforms supported by Fraudient. To use the Service, you must purchase advertising campaigns on the Ad Platform at your own cost. All negotiations, dealings, and engagements regarding these campaigns are strictly between you and the Ad Platform’s operator. Fraudient.com is not a party to these dealings.
1.2 To use Fraudient, you must first register. After registration, you can log in to your account and use the Service.
1.3 You are responsible for securing access to your account using your username and password. You must keep your password confidential. Fraudient.com assumes that you authorise all actions taken from your account after logging in. You are liable for these actions until you notify Fraudient.com that your password may have been compromised.
1.4 Fraudient may process personal data on your behalf. For the General Data Protection Regulation (GDPR), you are the “Controller,” and Fraudient.com is the “Processor.” You agree to indemnify Fraudient.com against all third-party claims arising from your obligations under GDPR and any other applicable data protection laws, including, but not limited to, the California Consumer Privacy Act (CCPA).
2. Terms of Use
2.1 You may not use Fraudient for any purpose that violates any regional, national, or other applicable laws or regulations. This includes, but is not limited to, storing or transmitting data that is defamatory, libellous, or discriminatory.
2.2 You may not request personal data without publishing an adequate privacy policy. When processing personal data, you must comply with the GDPR and CCPA.
2.3 Additionally, you may not use Fraudient to:
- Publish or distribute content that infringes copyright or contains hyperlinks to such content.
- Assist others in violating third-party rights, such as by linking to hacking tools or tutorials designed to commit illegal acts.
- Violate the privacy of others, such as by distributing personal data without consent or repeatedly sending unwanted communications.
2.4 If Fraudient.com becomes aware of any violations of the above terms, or if a complaint is made, it may take action to address the violation.
2.5 If Fraudient.com believes that the operation of its systems or networks, or those of third parties, is under threat or may be damaged, it may take any necessary steps to prevent or mitigate such damage.
2.6 Fraudient.com reserves the right to report any criminal offences committed through the Service to law enforcement.
2.7 Fraudient.com may seek compensation from you for any damages it suffers as a result of your violation of these terms. You agree to indemnify Fraudient.com against all third-party claims arising from such violations.
3. Availability and Maintenance
3.1 Fraudient.com does not guarantee the availability of the Service.
3.2 Fraudient.com actively maintains Fraudient. Maintenance may occur at any time and could temporarily affect the availability of the Service. Fraudient.com will provide advance notice whenever possible.
3.3 Fraudient.com may update or change Fraudient at its discretion. Your feedback is welcome, but the final decision on any updates is at the sole discretion of Fraudient.com.
4. Intellectual Property
4.1 Fraudient, its software, and all content on the website are the intellectual property of Fraudient.com. You may not copy or use any of these materials without written permission from Fraudient.com, except as permitted by law.
4.2 The information you store or process using the Service remains your property or that of your licensors. Fraudient.com is granted a limited license to use this information for the provision of the Service. This license can be terminated by removing the information or terminating the agreement.
4.3 If you provide Fraudient.com with suggestions or feedback, you grant Fraudient.com a perpetual and unlimited license to use this information unless marked as confidential.
4.4 Fraudient.com will not access your data stored or transferred through Fraudient unless it is necessary for providing the Service or required by law. In such cases, Fraudient.com will minimise access to your data as much as possible.
5. Compensation for the Service
5.1 Certain functions of Fraudient require payment. You will be informed of the fees for these functions. Fees are charged monthly or yearly and must be paid in advance.
5.2 You agree to pay the subscription fees as per the plan you select at registration.
5.3 Fraudient.com may change the applicable fees with written notice. These changes will apply to your next billing cycle. If you do not accept the changes, you may terminate your subscription before the new fees take effect.
5.4 Your subscription will automatically renew unless you provide notice of termination via email. Termination will take effect at the end of the current billing cycle.
5.5 Changes to your subscription plan will take effect in the next billing cycle. If you exceed your current plan’s limits, your subscription may be immediately suspended, and service will only resume upon upgrade to a suitable plan.
5.6 Payments can be made by credit card or other methods as detailed on the website.
5.7 You must keep your billing information current and accurate.
5.8 Fees are charged at the beginning of each subscription cycle. Any additional charges will be billed at the end of the cycle.
5.9 All payments are non-refundable. If you terminate your subscription, you will not receive a refund for any unused period.
5.10 Payment processing is handled by third-party providers, and their terms apply to those transactions.
5.11 If payment is overdue, Fraudient.com may charge interest and recover legal costs associated with collecting the overdue fees.
5.12 Because the Service is provided immediately upon request, no refunds are available under the Distance Selling Act.
6. Limitation of Liability
6.1 Fraudient.com’s liability is limited to the amount you paid in the three (3) months immediately preceding the incident, except in cases of intentional misconduct or gross negligence.
6.2 Fraudient.com is not liable for indirect damages, consequential damages, lost profits, or business interruptions.
6.3 Claims for damages must be submitted in writing within two months of discovery.
6.4 Fraudient.com is not liable for damages due to force majeure, including internet outages, power interruptions, strikes, natural disasters, and similar events.
7. Term and Termination
7.1 This agreement takes effect upon your first use of the Service and remains in force until terminated.
7.2 Consumers may terminate this agreement with a one-month notice period. Non-consumers must provide a two-month notice.
7.3 Fraudient.com may terminate the agreement if you have not used the Service for 12 months. A reminder email will be sent before termination.
7.4 Upon request, and for a fee, Fraudient.com can provide a copy of your stored data. Contact us for details.
8. Changes to Terms
8.1 Fraudient.com may modify these terms and conditions or any prices at any time.
8.2 Changes will be announced thirty days in advance through the Service.
8.3 If you do not accept the changes, you can terminate the agreement before they take effect. Continued use of Fraudient after the changes take effect constitutes acceptance.
9. Miscellaneous Provisions
9.1 This agreement is governed by Israeli law.
9.2 All disputes arising in connection with Fraudient will be resolved by the competent court in Israel, unless otherwise required by mandatory law.
9.3 For any clause requiring written communication, email or secure communication through the Fraudient service will suffice, provided the sender’s authenticity can be verified.
9.4 The version of any communication as recorded by Fraudient.com is deemed authentic unless proven otherwise.
9.5 If any part of these terms is declared invalid, it does not affect the validity of the remainder of the agreement. The parties shall agree on a replacement provision that reflects the original intent within legal limits.
9.6 Fraudient.com may transfer its rights and obligations under this agreement to a third party in the event of an acquisition or similar business transaction without requiring your consent.
